Fencing in Cheltenham: what to know

Cheltenham is our home turf: Expanse is based next door in Heatherton, so measures here are quick to book. The suburb straddles the Kingston and Bayside council areas, and its sandy soil digs cleanly and drains well, which is genuinely good news for fence posts. A lot of Cheltenham’s mid-century homes are being renovated, and a sharp new boundary fence is one of the cheapest ways to finish the job: 2.1m privacy fences behind the renovations, classic palings on the quieter streets.

Common fence issues in Cheltenham

Two councils in one suburb

Cheltenham is split between the City of Kingston, which covers the larger eastern side including the Charman Road shops and the council offices, and Bayside City Council, which covers the western streets toward the golf links and the bay. The two councils word their fence guidance differently, so the first step for any Cheltenham fence is confirming which one your rates notice comes from.

Post-war blocks becoming townhouses

Most of Cheltenham’s housing went up between the post-war years and the 1980s, and the station precinct and main roads are now seeing townhouse and apartment development. A single old back fence often becomes several shared boundaries with different owners, and Kingston usually needs a planning permit for a fence within 3m of the street on a lot with two or more dwellings or under 300 square metres.

Trees and trellis on the Bayside side

In the Bayside part of Cheltenham, established trees along back boundaries are common, and Bayside’s local law generally needs a permit to remove a tree with a trunk circumference over 155cm measured 1m above the ground. Bayside also counts trellis and privacy screens on top of a fence toward its height, so a 1.8m fence with 300mm of trellis is treated as a 2.1m structure.

Fence rules in Cheltenham (City of Kingston (western parts are in Bayside City Council))

For the Kingston side, Kingston’s fencing permits page says timber or steel side and rear fences under 2m, more than 3m from the front boundary, need no building permit, front fences under 1.2m need no permit, and fences over 1m within 9m of a street corner need a building permit and consent. For the Bayside side, Bayside’s fences page (bayside.vic.gov.au/fences) says a building permit may be needed where a fence is over 2m, higher than average or blocks sight lines, and that trellis and screens count. Either way, check with your council and your free VicPlan report before building.

Read the council’s own page before you design: City of Kingston (western parts are in Bayside City Council) fencing information. You can also look up your address, zone and any overlays with a free VicPlan property report. Rules change and every lot is different, so please check with council before you build. We flag height, corner and overlay questions at the on-site measure.

Sharing the cost with your neighbour. Under the Fences Act 1968, owners generally share the cost of a sufficient dividing fence equally, and you start by giving your neighbour a Fencing Notice (our free Fencing Notice generator does this). On townhouse sites, one boundary can be shared with two or three owners, and each generally pays half of the section they share under the Fences Act 1968. A separate Fencing Notice to each owner, showing their length, keeps the split clear.

Cheltenham fencing questions

How do I know if my Cheltenham home is in Kingston or Bayside?

Your rates notice says which council you pay, and a free VicPlan property report confirms it along with any overlays. Broadly, the eastern side of Cheltenham is Kingston and the western streets toward the bay are Bayside, but the line follows streets, so check your own address.

Does trellis on my Cheltenham fence count toward the height?

Bayside says the fence rules also cover trellis and privacy screens on an existing fence, so the combined height is what counts. Kingston works from the same state regulations. If the total goes over 2m, check with council about a permit before adding it.

My neighbour is building townhouses. What happens to our shared Cheltenham fence?

If the existing fence just needs replacing, the Fences Act generally splits a sufficient fence between the owners. If the development damages it, the party responsible is generally liable. Raise it with the developer early, and once the boundaries are settled we can quote a new full-height paling fence.

Can you do the measure on a weekday evening in Cheltenham?

Being this close to Heatherton makes Cheltenham one of the easier suburbs to fit around work hours. Book through the website with 24 hours notice, and the measure and written quote are free, with no obligation and no deposit.
